Definition of Personal Information

For Hitachi Construction Machinery, personal information is information that is related to existing persons and that can be used to identify specific persons (for example, names, birth dates, numbers assigned to individuals, symbols or other marks, images, or voice recordings, and relevant information) (hereinafter referred to as “Personal Information”).
This includes information that cannot be used to identify individuals by itself, but can be used to identify individuals by easy cross-referencing with other data. Personal information is not limited just to information that can identify individuals, but also includes all information that indicates facts, decisions, or evaluations relating to a person’s attributes (such as a person’s height or build, finances, work type, or position).
Based on the Personal Information Protection Policy given below, Hitachi Construction Machinery will pay detailed attention to, and expend the utmost efforts on, protecting and managing such information.

Scope

This “About Personal Information Protection” document establishes the handling of personal information by Hitachi Construction Machinery.

Personal Information Protection Policy of Hitachi Construction Machinery

1. Collecting, Using, and Providing Personal Information

While carefully considering the entrusting of customer information during company activities, Hitachi Construction Machinery will handle such information appropriately by establishing a management system for personal information protection for each type of business, and also by following stipulated rules for collecting, using, or providing personal information.

2. Following Laws and Norms

For the handling of personal information, Hitachi Construction Machinery will follow the Singapore laws and norms applicable to the protection of relevant personal information. Also, Hitachi Construction Machinery will create and follow personal information management rules that conform to these laws and norms.

3. Implementing Safety Measures

To ensure the correctness and safety of personal information, in accordance with the rules for information security, Hitachi Construction Machinery will implement various measures (such as managing access to personal information, restricting the means for transporting personal information outside the company, and preventing incorrect access from outside the company), and strive to prevent any problems with personal information (such as the loss, destruction, falsification, or leakage of information).

4. Respecting Your Rights Regarding Your Personal Information

When you make a request to reveal, correct, or delete your own personal information, or seeks to prevent the use or provision of such information, Hitachi Construction Machinery will respond with sincerity, respecting your rights related to that personal information.

5. Establishing Rules for Managing Personal Information Protection, and Making Continual Improvements

Hitachi Construction Machinery will make sure that executive staff and workers recognize the importance of personal information protection and will steadily establish rules for managing personal information to ensure that such information is used appropriately and is protected. These rules will be maintained and improved continually.

Purpose of Using Personal Information, and Providing to Third Parties

1. Hitachi Construction Machinery will use personal information only to achieve the following listed purposes (hereinafter referred to as the ''Purpose'').

a) To guide for conventions or meetings, or to guide for new products or services
b) To provide various types of member services
c) To provide after-service for products or services
d) To provide information regarding products and services which may be of interest to customers
d) To respond to various types of inquiries
e) To perform analysis to improve products or services
f) To send out questionnaires
g) To execute contracts
h) To execute duties under laws, regulations and norms

2. Hitachi Construction Machinery may provide following companies (hereinafter referred to as ''Affiliates'') with all or part of items of personal information to jointly use only to achieve the Purpose (hereinafter referred to as the “Joint Use”).

a) Hitachi Construction Machinery Co., Ltd., the parent company of Hitachi Construction Machinery (hereinafter referred to as “HCM”)

b) Hitachi Construction Machinery’s affiliated companies (of which 20% or more than 20% of issued shares are owned by HCM)

c) Hitachi Construction Machinery’s Sales distributors

3. Personal information to be jointly used

All the information set forth in the definition of the personal information will be jointly used.

4. Purpose of the persons who jointly use the personal information

The personal information will be jointly used in order to provide services through the global networks of Hitachi Construction Machinery and improve such services within the scope of the Purpose.

5. Hitachi Construction Machinery will not provide personal information to a third party without obtaining your prior consent, except for the joint use stipulated in the previous provision or in the following circumstances:

a) When required by law
b) When required to protect human life, to avoid injury, or to protect assets, and when obtaining your consent would be difficult.
c) When required to co-operate with the lawful activities of a national agency, local government organization, or person or organization entrusted with such a task, and obtaining your consent would interfere, or be likely to interfere, with the carrying out of such activities.
d) When providing a third party entrusted a business by Hitachi Construction Machinery with personal information in order to achieve the Purpose.

3. It is assumed that you agree to the contents of this “About Information Protection” document when you enter personal information into a Hitachi Construction Machinery website. If you do not agree with this “About Information Protection” document, you may be unable to use some of Hitachi Construction Machinery services (including responses to inquiries, etc.).

Special Notes

1. The personal information protection policy of Hitachi Construction Machinery is based on the Personal Data Protection Act of Singapore.

2. Hitachi Construction Machinery may modify this “About Information Protection” document as appropriate to accommodate improvements in the handling of personal information, or changes or additions to laws or other norms.

3. This “About Personal Information Protection” document goes into effect from the day it is published (including the update day).

4. If statements in this document are covered by individual regulations regarding personal information, those regulations take precedence.

NOTICE FOR INDIVIDUALS IN THAILAND

1. This Notice For Individuals In Thailand shall only apply to any website visitors and other individuals who are located in Thailand.

2. Purposes of Personal Information processing

In addition to Clause 1 of the Purpose of Using Personal Information, and Providing to Third Parties of the Privacy Policy, your Personal Information will be collected, used, disclosed, transferred and processed to the extent necessary for the following purposes:

•           Processing customer/business partner (including its employees and contact person) database.

•           Processing credit check and approval.

•           Processing KYC (know Your Customer).

•           Processing due diligence.

•           Executing agreement which you or your company is the party of the agreement, and you are the authorized director of the company.   

•           Processing any registration relating to the agreement, with the government sector.

•           Processing any marketing advertise including analysing data for marketing purpose.

•           Processing any accounting-related activities. 

•           To create user account for using online service of Hitachi Construction Machinery

•           To monitor any obligation regarding the agreement and to provide after-services including the satisfaction survey. 

3. Impact if Hitachi Construction Machinery doesn’t receive your Personal Information

Without the Personal Information requested above, Hitachi Construction Machinery may decline to execute the contract with you if such information is of essence to the contract.

4. Disclosure or transfer to third parties

Hitachi Construction Machinery will keep your Personal Information with strict confidentiality and will not disclose or transfer it to any third parties unless it is necessary to complete the purposes set out in 2 above, or it is under the command of government agent, or it is exempted by the laws, or it is allowed to disclose or transfer by the PDPA in 8 below or other laws.

In addition to Clause 2 of the Purpose of Using Personal Information, and Providing to Third Parties of the Privacy Policy , for the purposes set out in 2 above, Hitachi Construction Machinery may disclose or transfer your Personal Information to third parties including Affiliates, internal auditor, external auditor, consultant, data processor and the company who secures the document on our behalf.

5. Cross-Border Transfer

Personal Information may be transferred to Japan, Singapore or to other destinations outside Thailand. Nevertheless, in some cases, the data protection standards in the country to which the Personal Information is transferred may not meet the standards that the competent authority under the PDPA prescribes.

6. Retention period

Hitachi Construction Machinery will only retain your Personal Information for as long as necessary to fulfil the purposes set out in 2 above we collected it for, including for the purposes of satisfying any legal or accounting requirements.

To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorised use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances we may anonymise your Personal Information (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

7. Your rights under the PDPA

You have various rights under PDPA as follows:

- The right to request to access to your Personal Information

- The right to request to forward or transfer Personal Information, except where it is impracticable

- The right to object to the processing of Personal Information

- The right to request to delete, destruct and anonymize Personal Information

- The right to request to suspend the use of Personal Information

- The right to request to correct Personal Information to be correct, up-to-date, complete and not misleading

- The right to file a complaint in the event of a violation or non-compliance of the PDPA

- The right to withdraw the consent in relation to Personal Information that has been given to

   Hitachi Construction Machinery, but such withdrawal will not affect the processing of Personal Information for which you have given your rightful consent. In the event that the withdrawal of consent affects you in any matter, Hitachi Construction Machinery will notify you of such impact.

   In this regard, in exercising such right, you must submit to Hitachi Construction Machinery a written request for exercising rights in the form prescribed by Hitachi Construction Machinery. Hitachi Construction Machinery has the right to require you to verify your identification before exercising your rights. In addition, Hitachi Construction Machinery reserves the rights to consider your request and take action as required by applicable law.

8. The legal basis for processing the personal data without consent

Hitachi Construction Machinery shall not collect, use, disclose and transfer the Personal Information without obtaining your consent except for the following purposes where the consent is not required under the PDPA: 

(a)     To prevent or suppress the danger to a person’s life, body or health;

(b)     To be necessary for the performance of a contract to which you are a party, or in order to take any actions upon your request prior to entering into a contract;

(c)     To be necessary for legitimate interests of Hitachi Construction Machinery or any other person or juristic person other than Hitachi Construction Machinery, except where such interests are overridden by the fundament rights of your personal data;

(d)     To be necessary for compliance with the law by Hitachi Construction Machinery such as compliance with the order of the official authority under the PDPA or other laws and compliance with order or judgement of the court;

(e)     To be necessary for the performance of a task carried out for the public interest by Hitachi Construction Machinery, or for the exercising of official authority vested in Hitachi Construction Machinery;

(f)      To achieve the purpose relating to the preparation of the historical documents or the archives for public interest, or for the purpose relating to researcher statistics, in which the appropriate preventive measures to safeguard your rights and freedom are put in place and in accordance with notification as prescribed by the competent authority under the PDPA; and

(g)     Any other events which are not necessary to obtain consent under the PDPA.
